Terms and Conditions

1. The Service

Mining Flow is a tool for drawing mineral processing flowsheets, calculating mass and water balances and exporting drawings and reports as PDF. It runs in the browser and stores your projects in your account.

We may improve, change or discontinue features of the Service. If we discontinue the Service as a whole, we will give reasonable advance notice so that you can retrieve your projects.

2. Accounts

• You must be at least 18 years old, or the age of majority where you live, to create an account.
• You can sign up with an email address and password or with your Google account. The information you provide must be accurate.
• Each account is personal. Keep your credentials confidential; you are responsible for activity under your account. Tell us promptly at miningflow@yewcastle.com if you suspect unauthorized use.
• You can delete your account at any time on the Subscription page. Deletion removes your projects and cannot be undone.

3. Testing phase, subscriptions and payments

During the current testing phase, access is open to all accounts at no charge. We will announce the end of the testing phase in advance.

When paid plans become available, prices, billing periods and the applicable conditions will be shown before you subscribe. Payments will be processed by our payment provider (Stripe); we do not store full card numbers. Subscriptions renew automatically at the end of each period until you cancel; cancellation takes effect at the end of the period already paid. Refunds follow the conditions shown at purchase and the consumer laws that apply to you.

Without an active subscription, your projects remain stored and can be opened in read-only mode.

4. Your content

Your flowsheets, project data and other content you create or upload ("Your Content") belong to you. You grant YewCastle a limited, non-exclusive license to host, store, copy, process and display Your Content solely to operate, secure and provide the Service to you, including generating previews and PDF files and delivering copies you choose to send.

You are responsible for Your Content and confirm that you have the rights needed to use it, including any client or employer data it contains.

When you send a copy of a project to another person, that person receives an independent copy of the project as saved at that moment, together with your email address and any message you write. Later changes on either side do not reach the other copy, and we cannot recall a copy that has already been accepted.

5. Acceptable use

You agree not to:

• break the law or infringe the rights of others through the Service;
• access other users' accounts or data, or try to bypass security, access controls or usage limits;
• copy, decompile, reverse engineer or extract the source code, calculation methods or equipment catalog of the Service, except where the law expressly permits it;
• use bots, scraping or automated access that places an unreasonable load on the Service;
• use the sharing features to send spam or unsolicited messages;
• resell, sublicense or provide the Service to third parties as a service of your own.

6. Engineering results

The Service is a calculation and drawing aid. Results depend on the data, parameters and models you choose and may contain errors. You are solely responsible for checking all results and for any engineering decision, design, construction or operation based on them, which must be reviewed by a qualified professional. The Service does not replace professional engineering judgment.

7. Intellectual property

The Service, including its software, calculation engine, equipment symbols, catalog, design and the Mining Flow name and logo, belongs to YewCastle or its licensors and is protected by law. Except for the right to use the Service under these Terms, no rights are granted to you. Drawings and PDF files you generate with the Service are part of Your Content and you may use them freely; the optional "made with miningflow.app" credit can be turned off in your settings.

If you send us suggestions or feedback, we may use them without obligation to you.

8. Availability

We work to keep the Service available and your data safe, but the Service is provided over the internet and may be interrupted for maintenance, failures or reasons outside our control. Keep your own copies (for example, exported PDF files) of anything that is critical to your work.

9. Disclaimer of warranties

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

10. Limitation of liability

To the extent permitted by law, YewCastle will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunities, arising from or related to the Service. Our total liability for any claim related to the Service is limited to the greater of the amounts you paid us for the Service in the 12 months before the event giving rise to the claim and US$100.

Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud or willful misconduct, or rights you have as a consumer under the mandatory laws of your country.

11. Indemnity

To the extent permitted by law, you agree to defend and indemnify YewCastle against third-party claims arising from Your Content or from your breach of these Terms.

12. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or close accounts that seriously or repeatedly breach these Terms, or when required by law; where possible, we will notify you in advance and give you an opportunity to retrieve your projects.

Sections 4 (license limited to what is needed to complete deletion), 6, 7, 9, 10, 11 and 14 survive termination.

13. Changes to these Terms

We may update these Terms. The date of the last update is shown at the top of this page. For material changes, we will notify you by email or in the Service before they take effect. If you do not agree with the new Terms, you may stop using the Service and delete your account; continuing to use it after the changes take effect means you accept them.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Service will be brought in the state or federal courts located in the State of Delaware, unless applicable law requires otherwise. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring claims before the courts that those laws allow.

Before starting any formal proceeding, please contact us at miningflow@yewcastle.com so that we can try to resolve the issue informally.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer them in connection with a merger, acquisition or sale of the Service, with notice to you. These Terms are available in English, Spanish and Portuguese; the versions have the same content.
